Note that the reactions by both Chicago and New York government officials -- and the official word put out by the main-stream media -- regarding the activities of their respective taxicab workers is strikingly the same. When 80%, perhaps 90% of the taxicabs normally on the streets of New York disappeared, Bloomberg went on TV and made statements that are directly contradictory to reality.

 
Up to 12,000 taxicabs were out of service in New York and the mayor claims that there was little or no impact on the City! In Chicago on 7/31, when the taxicab workers demonstrated to the City of Chicago that we were a force to be reckoned with, when 80%, perhaps 90% of the taxicabs normally on the streets of Chicago disappeared, it was widely reported that there was little or no impact on the City.
 
Certainly there is little or no impact on the hearts of New York City officials when it comes to issues of sharing power with the taxicab workers of New York City. Certainly there was little or no impact on the hearts of our city officials who said "No" to our request for a surcharge or meter increase to help cover the highest gas costs in the USA and in history.
 
 
The official word then was "volatility" of gas prices does not constitute a reason for an increase or a surcharge.  The official word also was that there was little or no support by the drivers for an increase.  Both (volatility and lack of support) were and are directly contradictory to reality.
Apparently these government officials are in a state of denial when the issues brought before them are related to the taxicab industry.
 
They deny that there is any problem because if they were to admit that there is a problem, it would be an admission that they, repeat, they are mismanaging the affairs of the taxicab industry and that they are responsible for the dissatisfaction, the turmoil, the unrest and the almost total shut-down of their respective taxicab industries. It would be an admission by these government officials that they are acting like the power-hungry, money-grabbing, unscrupulous employers from whom government is supposed to protect us.
 
As a result, we must now learn to break our local governments' addiction to our money and our power, just like one would break the addiction of a crack addict.

Answer #1 to Aug 22 ,07 question is: This is very unfortunate, a life taken and one remains living in custody, however with 3 square meals a day for 7 years at the tax payers expense…is this justice ? …. Mr. Purcell is DEAD….. some will say “ Ah yes but if he had been safety educated , this tragic incident could have been prevented from happening”?????..... The best protection should be offered to cabbies > TAXI SHIELDS …… be proactive people!..... put up a BARRIER between the front and back seat of the cab…. Prevent cowardly acts like this …. Don’t be fooled to believe that driver education, Cameras, GPS (reactive systems) alone will stop physical premeditated attacks like this from happening…this 19 year old was out to do one thing…..we need to be proactive and be ready!
Question Aug 22, 2007 is: Should the quiet 19-year-old with a dimpled smile that was sentenced as an adult to life in prison with no chance of parole for seven years be fair? This youth then, took the life of the belated cabbie Kenneth James Purcell, who was brutal stabbed to death by him of all things, on Christmas morning in 2005.
 

Answer Tues, Aug 07, 2007: In addition to the EXCELLENT suggestions made below by a reader from San Francisco...You should also go down to your local O.S.H.A. office, give them the fact's about your " Job Requirements " from Mom & Pop and get their position on your " Status " ( I.C. or Employee ).

THEN ,,,, IF they FIRE  YOU, you can go back to OSHA & file a " 11 - C " Complaint..! The co. will have to PAY YOU for every minute that U were NOT on the job. Now...IF your local OSHA office play's the " DUMB ROLE " have them to contact Mr.Greg Barber @ O.S.H.A. in wash.D.C... his e-mail is Barber.Greg@dol.gov  Good Luck Brother....& Please keep us ALL posted Sir.......there are LOTS of " Experts " on the " I.C. My guess is that you would be called an employee based on the commission arrangement and the company paying for fuel. Cab companies usually try to avoid a direct linkage between the driver's income and the company's income. A commission or meter-split directly links the two.

In the real world, your status is a non-issue unless someone has a reason to review it. Your current ambiguous or hybrid status could continue for decades without any disturbance. It's also possible that you may be regarded as an employee for one agency's purposes, and as an IC for other purposes. The tests used to determine status may differ depending on who is deciding: NLRB or IRS, a state unemployment office or a worker compensation appeal board, or perhaps a court.

Question: do you want to be considered an employee or an independent contractor, and why?

Story Broke Tues, Aug 07, 2007: After being out of the industry for about 6 years this cabbie thought he might come back. This time he came back as a driver not a dispatcher. He answered a cab company ad in the paper for an established cab company that had just stated operating in a town close to his home. he went for the interview and it turned out to be a small mom and pop operation with 7 or 8 cars but he needed the money and they needed the drivers. he got the job before he walked out of the office.

When he was hired he was told that he would get 45% of his bookings. he was told that he would get a "gross" check each week and that they used 1099's. He was given a set schedule and days off. The company routinely calls you in early or holds you over late to meet demand (Not a driver option). The company assigns him a vehicle and Nextel each day to use at no expense to the driver. The company covers all expenses including gas, repairs and highway toll for all our cabbies. The company provides 24 hour dispatch service to the drivers and has said that drivers can not establish their own customer base or accept calls on their cell phones directly from customers. All calls must go thru the dispatcher.

The company does not compensate drivers for ghost calls, no shows or dispatcher errors. Drivers do not have the option of refusing calls even if it means the driver will have to work past his normal ending time. Now the real question - Is this cabbie an employee or an Independent Contractor?
